These are the general terms and conditions for use of www.Fayrouz.com (the “Site”). The Site is operated by Fayrouz Manufacturing and Technology Centre GmbH (“Fayrouz”). Please read these terms and conditions carefully.
By using the Site, you agree to these terms of use in full. You understand and agree that these terms of use constitute the entire agreement between Fayrouz and yourself in respect of your use of the Site and supersede any and all prior arrangements, agreements and representations between us.

1. What you are allowed to do:
You may only use the Site for personal use and only in accordance with these terms. Additional terms may apply to the use of particular parts of the Site and products and services which are available from it from time to time. You may print one copy of any page of the Site, for your own personal purposes, provided you do not do any of the things set out under “What you are not allowed to do”.
2. What you are not allowed to do:
Except to the extent expressly set out in these terms, you are not allowed to: (i) make any copies of any part of the Site: or (ii) remove or change anything on the Site. You must only use the Site and anything available from the Site for lawful purposes, and you must comply with all applicable laws, statutes and regulations.
3. Intellectual Property Rights:
All intellectual property rights in any material (including text, video, photographs and other images and sound, trade marks and logos) contained in the Site are owned by Fayrouz or its licensors and are protected by UK and international copyright laws and other intellectual property rights. You are only allowed to retrieve and display the content of this Site on a computer screen or print off one copy of such content for your own personal use, provided you do not remove or change any copyright, trade mark or other intellectual property right notices contained in the original material or printed off from the Site.
4. Information from the Site:
(a) The Site contains information of a general nature and should not be treated as comprehensive. You should take appropriate professional advice before relying on the information on the Site.

5. No warranties – Limitation of liability:
To the maximum extent permissible under any applicable law Fayrouz makes no warranties and limits its liability as follows:
5.1. We provide the information and/or services “as-is” “with all faults” and “as available.” We do not guarantee the accuracy or timeliness of information available nor the service. Fayrouz give no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws that this contract cannot change. We exclude any implied warranties including those of satisfactory quality, fitness for a particular purpose, workmanlike effort and non-infringement.
5.2 Fayrouz shall not be liable for any loss or damage of whatever nature (including but not limited to (a) direct loss of profits, anticipated savings, wasted expenditure, (b) indirect and/or consequential damages or loss of profit, (c) special or punitive damages, in each case resulting from or in connection with your access to, use or misuse of the Site, or reliance on the Site, regardless of whether such loss or damage would arise in the ordinary course of events or otherwise, is reasonably foreseeable or otherwise, or is caused by any error or omission in the Site (whether or not negligent). For the avoidance of doubt, nothing affects any liability which may not be excluded or limited by any applicable law.

The Site may from time to time include links to external sites and co-branded pages. Fayrouz has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting and do not imply that Fayrouz approves or recommends the content of such websites. Fayrouz is not responsible for the content of these sites and pages or for anything provided by them and does not accept any obligation, gives no assurance and assumes no liability or responsibility (whether express or implied) in relation to any content of any other website.
7. Viruses:
Fayrouz accepts no responsibility or liability for any damage to hardware or software caused to you by downloading material from the Site. You must ensure that your computer has all necessary software to protect you from computer viruses.
8. Suspension and termination of service:
Fayrouz may suspend or terminate the operation of the Site at any time. Access to or use of the Site or any pages linked to it will not necessarily be uninterrupted or error free.
9. Personal Data:
If you contact us through the Site, Fayrouz shall act and use your personal data in compliance with Data Protection Act 1998. Fayrouz will only collect personal data from individuals who contact it directly via the address given at the head of these terms and conditions. Such information will only be used in relation to the enquiry or complaint and the individual’s details will be deleted once the enquiry or complaint has been resolved. Fayrouz will be the data controller with regard to this information and will be represented in the United Kingdom by AMP London.
Use of this web site outside the Netherlands
If you use this site from outside the United Kingdom you are responsible for compliance with any and all applicable local laws. Fayrouz makes no representation that the materials contained within this site are appropriate for countries outside the United Kingdom.

Personal information means personnaly identifiable information such as your name and address, telephone number, credit card information or e-mail address. Please be assured that Fayrouz will not collect any personal information from your visits unless you provide this information voluntarily.

Fayrouz may change these terms and conditions from time to time and will endeavour to notify you of any major changes by posting a message on the Site. If any provision of these terms and conditions is found to be unenforceable, this shall not affect the validity of any other provision. Fayrouz may delay enforcing its rights under these terms and conditions without losing them. Fayrouz will not be liable to you for any breach of these terms and conditions which arises because of any circumstances which Fayrouz cannot reasonably be expected to control. You agree that Fayrouz may sub-contract the performance of any of its obligations or may assign these terms and conditions or any of its rights or obligations without giving you notice. The parties do not intend these terms and conditions to be enforceable by any person who is not a party these terms and conditions pursuant to the Contracts (Rights of Third Parties) Act 1999. These terms and conditions shall be governed by English law, and you consent to the non-exclusive jurisdiction of the English courts.
